Terms of Service

1. About these terms

These terms apply to services provided by Enelyst Ltd ("Enelyst", "we", "us"), registered in England & Wales (company number 16240369), registered office 3rd Floor, Old Stock Exchange, St Nicholas Street, Bristol, BS1 1TG, England. By booking a service with us you agree to these terms. If anything here is unclear, ask us before you book at hello@enelyst.co.uk.

2. Quotes and bookings

  • All quotes are provided in writing and are free of charge and without obligation.
  • Quoted prices exclude VAT unless stated otherwise.
  • Quotes are valid for 30 days from the date issued.
  • A booking is confirmed once we agree a date with you in writing. Where a fixed price has been quoted, that price will not change unless the scope of the work changes or material information provided to us turns out to be inaccurate.

3. Your responsibilities

To carry out an assessment, survey or works we need you to:

  • Provide safe access to the property at the agreed date and time, including lofts, plant rooms, meters and other relevant areas where reasonably accessible;
  • Give us accurate information about the property and its systems when asked;
  • Tell us in advance about any hazards, restrictions or special access requirements;
  • Obtain any permissions needed for us to attend (for example from tenants, occupiers or building management).

If we cannot access the property, or key areas of it, we may need to reschedule or issue the assessment based on the evidence available, which can affect the result.

4. Assessments and certificates

  • All statutory assessments (EPCs, DECs, TM44 inspections) are carried out by accredited assessors and lodged on the relevant official register where required by law.
  • An energy assessment reflects the evidence available on the day of the visit, applying the government-approved methodology. It is not a building defects survey, structural survey or valuation, and it does not certify the safety or condition of any installation.
  • Ratings are produced by the approved calculation methodology. We cannot guarantee a particular rating in advance, though we will always advise on realistic ways to improve one.
  • Reports and certificates are prepared for the client who commissioned them and the purpose stated. Third parties rely on them at their own risk unless we agree otherwise in writing.

5. Fees and payment

  • Invoices are issued on completion of the work unless agreed otherwise, and are payable within [14/30] days.
  • For some services we may ask for payment, or a deposit, before the visit; we'll tell you when you book.
  • Certificates and reports may be withheld until payment has been received in full.
  • We may charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Cancellations and rescheduling

  • You can cancel or reschedule free of charge with at least [48 hours'] notice before the appointment.
  • With less notice, or if we attend and cannot gain access, we may charge an abortive visit fee of up to [50%] of the quoted price to cover assessor time and travel.
  • If we need to reschedule (for example due to assessor illness), we will offer the earliest available alternative and you may cancel without charge.
  • If you are a consumer booking at a distance, you may have a statutory 14-day cancellation right under the Consumer Contracts Regulations 2013. By asking us to carry out the service within that period, you agree we may begin, and you may lose the right to cancel once the service is complete.

7. Subcontracting

Some services are delivered through our network of accredited assessors and vetted specialist contractors. We remain your point of contact and responsible for coordinating the work. Where works (such as retrofit or installations) are contracted directly with a third-party installer, that installer's own terms and guarantees will also apply; we'll make this clear before you commit.

8. Liability

  • Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law.
  • Subject to that, our total liability arising from a service is limited to the fees paid for that service.
  • We are not liable for indirect or consequential losses, for example loss of rent, delayed transactions or loss of profit, arising from the timing or outcome of an assessment.
  • We hold professional indemnity and public liability insurance appropriate to the services we provide; details are available on request.

9. Complaints

If something isn't right, tell us at hello@enelyst.co.uk and we will respond within five working days. Statutory assessments are also covered by the complaints and appeals procedures of the relevant accreditation scheme (such as Quidos or Elmhurst Energy), which we'll signpost if we can't resolve the issue directly.

10. General

  • These terms are governed by the law of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
  • If any part of these terms is found to be unenforceable, the rest remains in effect.
  • We may update these terms from time to time; the version in force when you book applies to your booking.
  • Nothing in these terms affects your statutory rights.
